Kadıköy Municipality (hereinafter referred to as the Administration) provides users with different academic studies, business development, application development, investment, different analysis and interpretation studies, etc. In order to provide benefits in the fields, the data that is not safe to be shared legally is made available on the Kadıköy Open Data Portal located at https://acikveri.kadikoy.bel.tr. Your use of the data shared on Kadıköy Open Data Portal for any purpose means that you accept and undertake all the conditions stated below and all legal basis, provisions and legislation, especially the KVKK, regarding data sharing and use, and all kinds of responsibilities arising from these provisions. Kadıköy Open Data Portal officials reserve the right to terminate your use of data if you do not comply with the terms and conditions in question while using the data on this portal. These conditions apply to all real and legal users. In addition, the additional terms of use determined for different data sets will be deemed to have been accepted by you.

The Administration determines the data sets that comply with KVKK, Intellectual Property Law and all relevant legal regulations through the Open Data Portal and makes them available to users who want to use them for various purposes. Users are deemed to have accepted the Terms of Use created in this context by accessing these data sets put into service, using the data obtained from this portal for different purposes by deriving them. In case the data you have obtained is used, derived or benefited on behalf of any third party or legal entity; In order to use this data on behalf of the relevant person or legal entity, you declare and undertake that you will ensure that they comply with the Terms of Use.

Definitions

Data:

All kinds of information within the scope of data sets in Kadıköy Open Data Portal.

Data Owner/Provider:

The person or institution that provides data entry and updating in Kadıköy Open Data Portal.

User:

Natural or legal persons using Kadikoy Open Data Portal.

The intellectual property rights of all data presented in Kadıköy Open Data Portal belong to Kadıköy Municipality and cannot be transferred to another person/institution/organization. These terms of use do not imply that you are authorized to exercise these rights.

Kadıköy Open Data Portal contains data that is checked and published by the Administration after it is provided by the Administration and other persons or institutions. The Administration does not guarantee that these data contain true, accurate, precise, clear and up-to-date information. The data is provided on an as is and as available basis, without warranty of any kind, express or implied. The data contained in the portal; You agree that it cannot be used without examining and verifying its accuracy, timeliness and scope. Data Owner/Provider, including requests from 3rd parties, inaccurate, incomplete, outdated, etc. is not liable for any direct or indirect (including, without limitation, loss of use, loss of time or data, interruption of service, loss of business, loss of profit or savings) losses and damages resulting from data. You declare and undertake that you cannot hold the Data Owner/Provider responsible for such damages or losses that may occur directly or indirectly as a result of your data use.

Kadıköy Municipality, which is the Data Owner/Provider, is fully authorized to create, publish, update and delete the data in the Kadıköy Open Data Portal. Data can be updated, deleted, added and/or overwritten and such definitions regarding data are determined by the Data Owner/Provider. It is up to the Administration whether to keep old versions of this data or not. The Administration is not responsible for the production or modification of the data in the Kadıköy Open Data Portal by third parties in different environments.

These terms of use are subject to the laws of the Republic of Turkey and will be interpreted according to the laws. In case of any dispute arising from these Terms of Use, the courts of the Republic of Turkey are authorized.

Any changes to the articles in these terms of use or waiver of the authority to use the existing rights will not be accepted, except for any means discussed in writing between the user and the Administration.

These terms of use include all articles related to the use of data in the Kadıköy Open Data Portal between the user and the Administration and replace other previously determined agreements.

Any substance from these terms of use, etc. if it is deemed invalid by the institutions, this situation is only related to the relevant article; other articles will remain in effect.

If the administration does not use or refrains from using any of its legal rights based on the articles in these terms of use, it will not mean that it has waived this right, and its use of this right will always be reserved.
